What happens when a neighboring house is built and does not meet the side yard set back requirements in Ont.?

A house was built behind me. Its side yard abuts my back yard. There is supposed to be a minimum of 3.93 feet from the house to my lot line. There is only 3.24 feet. Now what happens. Can I receive a monetary settlement for the non-compliance?
